Overview

It is not necessary to have a notice of copyright (i.e.: © 1997 Jane Doe) for material to be copyright protected in the U.S. Once something tangible is produced, text, graphics, music, video, etc., it is automatically copyrighted. Sound recordings and some other property use other copyright symbols. Anyone can use the copyright symbol on her or his original work.

What does that have to do with the internet and the web? Copyright laws still pertain to the internet. This is so because it is not necessary to have a notice of copyright (i.e.: © 1997 Jane Doe) for material to be copyright protected in the U.S. Once something tangible is produced, text, graphics, music, video, etc., it is automatically copyrighted. Sound recordings and some other property use other copyright symbols. Anyone can use the copyright symbol on her or his original work. But due to this, things created on a webpage falls under that category of being something tangible and produced.

What are some of the things that are protected on a web site? Things such as links, original text, graphics, audio, video, html and other markup languages, list of web sites compiled by an individual or organization, and all other unique elements that make up the original nature of the material.

There are things that you can do with web pages and there are other things that you cannot do. The things you can do are link to other web sites, but some sites may have some restrictions and specific instructions when you link to its website or any specific page element. It is smart to ask permission and to cite sources when you are paraphrasing or quoting any material. You may also use free graphics on your web page; usually these graphics are advertised as ‘free’.

The things you should NOT do is put contents of someone else’s page on your own. This includes copy and paste information from various sources to construct something you can claim as your own. It is smart to give credit when you can. Also you cannot incorporate other people’s electronic material without permission; this includes forwarding an email to another person without asking. Also you may not change or edit the context of someone’s digital correspondence which will change the meaning (usually in forums). Also you should not copy and paste logos, icons, pictures/images, lists of resources, graphics unless it is clearly marked as ‘free’.

It is very important to abide by copyright rules and regulations. Failure to do so may cause problems, even legal actions to be placed against you. These are federal regulations and to find out more you can visit the U.S. Copyright Office.
